These Terms of Service govern access to and use of the MEDIAPRONET website, applications, CRM tools, website builder, APIs, and related services. By accessing or using the service, you agree to these Terms.
Key points
- You receive a limited right to use the service for internal business purposes during an active subscription.
- You remain responsible for the legality, accuracy, and rights status of the data and content you put into the platform.
- Abuse, unlawful activity, credential sharing, or interference with the service can lead to suspension or termination.
- If you sign a separate order form, MSA, or DPA with us, that agreement controls where it conflicts with these Terms.
Eligibility and acceptance
You may use the service only if you have the legal capacity to enter into a binding agreement and you are authorized to act on behalf of the business or organization using the account.
If you use the service on behalf of an entity, you represent and warrant that you have authority to bind that entity to these Terms.
Our service
MEDIAPRONET provides tools for lead capture, contact management, pipeline tracking, automation, analytics, website building, and related business workflows.
We may modify, update, improve, or discontinue features from time to time. We will use reasonable efforts to avoid materially degrading core paid functionality without notice, except where changes are required for security, legal, or operational reasons.
Accounts and account security
- You must provide accurate registration and billing information and keep it up to date.
- You are responsible for activity that occurs under your account and for maintaining the confidentiality of credentials.
- You must promptly notify us if you suspect unauthorized access, credential compromise, or another security incident affecting your account.
- We may require identity or authority verification before granting access to certain account changes or support actions.
Customer data and compliance responsibilities
You retain responsibility for all content, personal data, communications, files, forms, and records submitted to or generated through your use of the service.
You represent and warrant that you have all rights, notices, and legal bases necessary to collect, upload, store, use, send, and otherwise process customer data through the platform.
You are responsible for your own privacy notices, consent mechanisms, retention choices, and compliance with laws applicable to your business, industry, and geography.
Acceptable use restrictions
- Do not use the service in violation of law, regulation, court order, contract, or third-party rights.
- Do not upload malware, harmful code, deceptive content, or materials that infringe intellectual property, privacy, publicity, or confidentiality rights.
- Do not probe, scan, reverse engineer, scrape, overload, or interfere with the service, security controls, APIs, or infrastructure except as expressly permitted in writing.
- Do not use the service to send spam, unlawful marketing messages, or abusive, fraudulent, defamatory, or misleading communications.
- Do not resell, sublicense, lease, mirror, or provide unauthorized third-party access to the service unless your plan or a written agreement explicitly permits it.
Fees, billing, and renewals
Paid features are billed according to the pricing, plan terms, and billing cycle shown at checkout, in an order form, or in another written commercial agreement with us.
Where a free trial is offered, trial length, included features, and conversion timing are determined by the offer displayed at sign-up. Based on the current public site, the Starter plan is marketed with a 14-day free trial, while Pro and Agency are marketed with a 7-day free trial.
Unless otherwise stated, subscriptions renew automatically for successive billing periods until canceled. You authorize us and our payment processors to charge applicable fees, taxes, and other amounts due.
Late or failed payments may result in suspension of access, downgrade of features, or termination after reasonable notice where appropriate.
Intellectual property and feedback
The service, software, interface design, branding, documentation, and related materials are owned by MEDIAPRONET SRL or its licensors and are protected by intellectual property laws.
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business purposes during the active subscription term.
If you submit suggestions, ideas, or feedback, you grant us a worldwide, royalty-free right to use and incorporate that feedback without restriction or compensation.
Third-party services and integrations
The service may interoperate with third-party services, domains, hosting providers, payment processors, email tools, analytics vendors, communication platforms, and similar external systems.
We are not responsible for third-party products or services, their availability, security, content, or legal terms. Your use of third-party services is governed by the terms and policies of those providers.
Suspension and termination
You may stop using the service or cancel your subscription according to the applicable billing terms.
We may suspend or terminate access immediately if we reasonably believe there is unlawful use, a security threat, non-payment, material breach, or conduct that exposes us, our users, or third parties to risk.
Upon termination, your right to use the service ends. We may delete or disable access to customer data after a reasonable post-termination period unless a longer retention is required by law or agreed in writing.
Disclaimers
To the maximum extent permitted by law, the service is provided on an as-is and as-available basis. Except as expressly stated in a signed agreement, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.
We do not warrant that the service will be free from all downtime, defects, delays, data loss, or security incidents, or that use of the service will by itself satisfy any legal or regulatory requirement applicable to your business.
Limitation of liability
To the maximum extent permitted by law, MEDIAPRONET SRL and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill, or loss of data arising out of or related to the service.
To the maximum extent permitted by law, our aggregate liability for all claims arising out of or relating to the service will not exceed the amounts paid by you to MEDIAPRONET for the service during the twelve months preceding the event giving rise to the claim.
Governing law and disputes
